Lesson No. 1: No more excuses and favors for riverside squatters living in danger zones.

“This time around we’ll be very strict. I think now people have no reason to resist when we ask them to move out of these hazard areas,” she told the Inquirer on Tuesday.

Lesson No. 2: There should be a minimum height standard for the construction of residential and commercial buildings, depending on how elevated the place is.

This, Fernando said, would help prevent cases of people drowning inside their homes.

“Even just one car blocking the road can impede rescue workers from reaching their destination,” she said.

“The rescuers had to scramble for equipment so we need more of these prepared,” Fernando said.

Losses could reach P10B

The mayor said the city government would more thoroughly reflect on these lessons learned in the coming days in order to deal with catastrophes similar to that brought by Tropical Storm “Ondoy” (international codename: Ketsana) on Sept. 26.

“All our efforts are still focused on the rescue, relief and rehabilitation of the affected families,” she said.

Of the 300 deaths, 67 were from the Marikina area.

Fernando estimated property losses could reach as high as P10 billion. “Ondoy wrecked barges, footbridges, computer equipment at City Hall, medical equipment in hospitals.”

She said some 2,000 people remained in about 10 evacuation centers. Officials had moved them from schools to barangay halls so classes could resume.

Some 1,000 residing in riverside communities would have to be relocated, possibly in Biñan, Laguna, said the wife of Metropolitan Manila Development Authority Chair Bayani Fernando, who as a mayor developed the backward town into thriving city. Gargantuan task

Marikina Rep. Del de Guzman said those living at “Riverside A and B” in Barangay Fortune would be better off moving elsewhere.

“I don’t have the power, but I could convince them not to return there,” he said.

Most of the city’s efforts are directed at cleaning muck and debris.

Fernando said workers were using a city property at Barangay Nangka as a temporary dump for garbage, mostly beds, wood scraps, couches and sofa beds, and even appliances like refrigerators damaged beyond repair.

MANILA, Philippines - The Marikina City government spent P10 million of its calamity fund, supposed to be used only in times of disaster, for other purposes last year, according to the Commission on Audit (COA).

State auditors noted that since there was no declaration of a calamity in Marikina last year, expenses worth P10,302,549.53 made by the city government were charged to its calamity fund.

These expenses included salaries and wages worth P47,980; rice subsidy of employees worth P250,000; purchase of ready mix concrete worth P151,525 and thermoplastic lane remarkings worth P9,853,044.53.

Based on Republic Act 8185, the calamity fund must be used “for relief, reconstruction, rehabilitation and other works or services in connection with the calamities which may occur during the budget year, provided that such fund shall be used only in the area, or a portion thereof, of the Local Government Unit affected by a disaster or calamity.”

According to state auditors, documents supporting those transactions charged to the calamity fund in 2008 showed that these were not in any way related to disaster or calamity response.

The COA report said this examination of the expenses “casts doubt on the legality and validity of the said transactions.”

State auditors said that when presented with the audit findings, the Marikina City government, “did not comment on this.”

COA auditors said the city government must replace the P10.30-million worth of calamity fund and strictly follow rules governing its use.

“We’re asking MMDA Chairman Bayani Fernando to explain this both to the public and to the Cabinet to the satisfaction of all because this is a serious issue indeed,” Press Secretary Cerge Remonde said.

Reports said that the P1-billion flood warning system had been neglected following its transfer to the MMDA.

The flood warning system could have cushioned the adverse effects, particularly the heavy flooding experienced in the metropolis in late September during the lashing of tropical storm “Ondoy.

Based on a report by Newsbreak, the Japanese project Effective Flood Control Operation System (EFCOS) could have minimized casualties if the flood warning equipment and devices had reportedly been well maintained when it was transferred to the MMDA.

The flood warning system reportedly amounted to P1.1 billion, aimed at controlling flood control operations for the Pasig-Marikina-Laguna Lake.

The Japanese government had pegged P600-million for the first phase of the project, which was completed in 1992 while the second phase, at P500-million was funded through a grant by the Japan International Cooperation Agency, which was completed in 2001. MANILA, Philippines--Giving P1.6 million in cash to Metropolitan Manila Development Authority (MMDA) Chairman Bayani Fernando was "irregular," a government auditor told senators yesterday.

"It's irregular because it's not compliant with rules and regulations," said Ireno Manalo of the Commission on Audit, referring to the cash gifts the Metro Manila Film Festival (MMFF) gave to Fernando on four separate occasions.

Manalo, who is also the MMDA's supervising auditor, made the statement after Senator Ramon "Bong" Revilla Jr. asked him whether the cash gifts were "illegal or legal."

The Senate yesterday started looking into the matter after Senate President Pro Tempore Jose "Jinggoy" Estrada's privilege speech last month questioning the cash gifts given to Fernando.

According to Estrada, the MMDA chief received a total of P1.1 million when he celebrated his birthday in 2003, 2005, and 2006. The amount was deducted from the MMFF's nontax revenues as well as the shares of beneficiaries from the proceeds of the annual film festival.

At the first joint hearing of the Senate blue ribbon and public information and mass media, Assistant Secretary Edenison Faisan, head of the MMFF finance committee, said that Fernando also received a cash gift of P500,000 in 2004, bringing the total amount to P1.6 million.

Estrada and Revilla learned from MMFF officials that Fernando was given the birthday cash gifts for his role in making the annual filmfest a moneymaker. The MMDA chief is the overall head of the MMFF.

Espiridion Laxa, chair of the Film Academy of the Philippines, said the money did not come from amusement taxes but from private funds, specifically from sponsorships.

The senators expressed surprise when Manalo told them that there was no record of the amount of amusement taxes collected or disbursed in the MMDA's books of account.

Meanwhile, Fernando said he saw no need to defend himself in the Senate because the cash gifts given to him came from "private funds."

Fernando said he did not attend the hearing because it was "pointless." He added, however, that he would present himself before the Senate "in due time."

At the same time, he confirmed that he received the cash gifts although he said the money went to his "favorite charities."

A larcenous longtime employee of a major Queens jewelry manufacturer walked off with a staggering 500 pounds of gold she smuggled out piece by piece over six years -- in her handbag, prosecutors said yesterday.

Teresa Tambunting, 50, of Scarsdale, sneaked the hoard out of a Long Island City vault by stashing "a few ounces" at a time in a false bottom she created in the lining of her pocketbook, authorities said.

"I am a very sick woman. I took the gold," she told her stunned bosses once the jig was up, according to sources.

Officials at Jacmel Jewelry caught on that they were being bled dry after doing an internal audit in January and noticing they were missing as much as $12 million worth of gold, which now trades for around $900 an ounce.

"The defendant is accused of establishing a virtual mining operation in Long Island City which siphoned off millions of dollars' worth of the precious metal," said Queens District Attorney Richard Brown.

Tambunting had worked for Jacmel for 28 years, joining the company shortly after emigrating from the Philippines, and had been made a vault manager in 1991. She was paid $160,000 a year and was one of only a handful of "highly trusted" employees who had access to the company's safe, sources said.

But even those people were subject to searches by security -- which Tambunting got around with the makeshift hole in a beaten-up black leather, banana-shaped purse she carried for years.

A few days after company officials started going over their books to see if they had made an accounting error, Tambunting walked into work wheeling a piece of luggage containing 60 pounds of "fine gold" -- or buck-shot-sized pellets of unrefined precious metal.

When asked if that was all she had taken, she said yes, but days later, she changed her tune and came in with her lawyer --and a couple of dozen five-gallon paint buckets filled with 447.8 pounds of gold necklaces, rings, earrings and other jewelry. There was enough gold to fill 12 large storage bins.

The size of Tambunting's haul stunned employees.

"When they walked in the first time, they were shocked and their jaws dropped," a source said. "When she came back three weeks later, their jaws dropped even heavier."

The stash took company officials nearly three weeks to inventory. During that period, they discovered some pieces that dated back to early 2004. Then they went to the DA.

In all, the value of the returned gold is roughly $7.3 million, meaning $4.7 million remains missing. Some of that, sources said, could have been lost in routine manufacturing processes.

They said Tambunting and her husband, Edgardo, a director at Cantor Fitzgerald, appeared to be living within their means, but probers were still investigating their finances.

The couple lives with their three children in a million-dollar home.

Jacmel Jewelry President Jack Rahmey called Tambunting "a longtime employee and a trusted one," but declined to comment any further.

She was released Tuesday on $100,000 bail. She faces up to 25 years in prison if convicted. Her lawyer did not return messages.

Officials say as much as $12 million worth of gold -- which trades at roughly $900 a troy ounce -- disappeared. With a single gold bar weighing 400 troy ounces, or 27 pounds, that's the equivalent of 833 pounds of gold, or just shy of 31 gold bars.

Of all the government agencies, the Metropolitan Manila Development Authority (MMDA) under Chairman Bayani Fernando seems to be the most “autonomous,” as far as running its financial affairs are concerned. Through the MMDA, Fernando has been carrying on as if he were the chief of state of an independent republic. It looks like he will continue to enjoy this privileged status for as long as he remains on the good side of President Arroyo.

Nobody with oversight powers has so far questioned him on how he has been running MMDA finances. And that’s just the way he likes it, it seems.

The Commission on Audit (COA), as a rule, is averse to the idea of zealously exercising its mandated power of review on a fellow agency directly reporting to the President. Only if and when President Arroyo herself specifically directs it to step in and review this agency’s books of accounts will the COA dare do its mandated job. But the President, who has been dotingly giving Chairman Fernando a free hand in running the MMDA, never once ordered such an audit over the past six years. Sad, but true. If only she knew what a devastating effect the MMDA’s excesses and crazy schemes have had on her own satisfaction rating in Metro Manila, she would have long booted him out.

As things now stand, the COA leaves the MMDA pretty much to its own devices. There has been no directive to that effect from the mountain- top so far.

What we have in the MMDA is an agency that has been handling untold billions in revenues, whose annual budget and expenditures have not once been subjected to a meticulous audit since Fernando took over six years ago. The MMDA’s financial affairs have never been conducted in “open sunlight” for the public to readily behold.

The MMDA’s virtual immunity from audit, plus its unwillingness to open its books, can only give rise to the suspicion that a lot of financial hanky-panky must be going on in this highly controversial agency.

Already, Fernando’s aggressiveness in promoting the use of those iron railings, iron urinals and overhead pedestrian walkways (also made of iron) all over the metropolis has provoked all sorts of speculations, all of them derogatory to Fernando.

Who is supplying these iron contraptions? Which metal fabricators are getting a bonanza of orders from the MMDA? How are these procurements priced? Are such purchases in accordance with the provisions of the procurement law? Are honest-to-goodness public biddings being held, or are they routinely rigged to favor favored suppliers and contractors?

The fact that Fernando is a civil engineer and that he owns several companies in the construction and steel-fabrication business only makes the public all the more suspicious. It may be strictly happenstance, but add to that input his public declaration that he would run for the presidency in 2010, and the public can’t help but put two and two together.

Fernando has blanketed the countryside with his expensive two-by-three-meter kaayusan all-weather posters. The question is, who paid for these posters? Let’s hope it wasn’t the MMDA, but only an audit can determine this for sure. In any case, the question that must be on the minds of prospective rival presidential candidates is this: How did Fernando build up the political war chest that he has begun to use for his precampaign propaganda?

To sustain a decent presidential campaign, one needs a minimum of P5 billion. As speculation would have it, Fernando has amassed more than double that amount.

The question is inevitably this: Can being chairman for six years of an audit-free MMDA be that lucrative? The public recalls quite vividly that about four years ago, the President had appointed Fernando as public-works secretary in a concurrent capacity (he didn’t want to let go of the MMDA). It did not take long before he casually chucked the public-works portfolio.

Why? I can only think of one reason: Technically, the government agency charged with the responsibility of taking care of national roads everywhere, including those in Metro Manila, is the Department of Public Works and Highways (DPWH).

(In Metro Manila, that function has all but been taken over by the MMDA. All contracts pertaining to these national roads are awarded by the MMDA.)

As public-works secretary, in short, he would be in constant conflict with himself.

Moreover, as public-works chief, all DPWH expenditures and contracts would have been subject to regular auditing and review not only by the COA, but also by the House appropriations committee, which decides on the size of the government’s yearly infrastructure budget.

At the MMDA, in stark contrast, public funds are practically audit-free, just like the intelligence fund of the President, which is exempt from pre- or postaudit regulations. So Fernando sacrificed the DPWH portfolio and retained the MMDA chairmanship. As MMDA chairman, he has the best of both worlds.

MANILA, Philippines—For these “Reds,” Metro Manila hardly looks pretty in pink.

A group of left-leaning lawmakers wants the House of Representatives to investigate—in aid of legislation—the use by the Metropolitan Manila Development Authority (MMDA) of bright pink as standard color for road signs and structures.

The group says the pink signs and structures not only mar the urban landscape but also violate local and international safety regulations.

“[They] are, at best, eyesores that worsen the visual blight plaguing Metro Manila,” according to a resolution filed last month by Bayan Muna Representatives Satur Ocampo and Teodoro Casiño; Gabriela Representatives Liza Maza and Luzviminda Ilagan; and Anakpawis Rep. Rafael Mariano.

MMDA Chair Bayani Fernando, however, is standing by his motif, saying the national capital’s “drab environment” can use a rosy accent here and there.

He maintains there is no “ban” on the use of pink for such public structures.

The lawmakers describe the pink signs and structures as nuisances that “offend the senses” and are prohibited under the Civil Code.

The group also argues that Fernando’s choice of color violates the Vienna Convention on Road Signs and Signals and similar international agreements in which the Philippines is a signatory.

The convention, the lawmakers say, specifies white, yellow, red, black, blue, green, orange and gray as internationally accepted colors for road signs, road markings and traffic lights. It also sets a standard size and shape for particular types of traffic signs, the lawmakers add.

Nuisance defined

The agreement, forged in 1968, took effect on June 6, 1978.

The lawmakers say the MMDA traffic signs violate the country’s own Civil Code, which defines public nuisances as “any act, omission, establishment, condition of property, or anything (which) annoys or offends the senses.”

Under the code, public nuisances can be the subject of a court case or a claim for damages.

Administrative Order No. 160-A, based on the National Building Code, also bans billboards and signboards that defile, debase or offend the aesthetic and cultural values and traditions of the Filipino people, according to the lawmakers.

Fernando, who had earned both praise and criticism as a no-nonsense, iron-fisted enforcer since becoming MMDA chair in 2002, has early on defended his preference for pink traffic signs, fences, walkways and sidewalk urinals.

Reached for comment on the House resolution, Fernando insists that his agency has not violated any Philippine law or international standard. “There is no ban on the use of pink,” he says in Filipino.

“I [first] used the color green when I was mayor of Marikina. The pink evolved when the World Health Organization designated Marikina as outstanding healthy city. So we came up with a motto: ‘Marikina, the City in the Pink of Health.’ To dramatize this, we began using pink,” he says.

“It’s the same thing we want for Metro Manila—for it to be in the pink of health.”

MANILA, Philippines—The son of Agrarian Reform Secretary Nasser Pangandaman and several persons beat up a 14-year-old boy and his father at a golf course in Antipolo on Friday, the victims complained Saturday.

The alleged attackers were identified as Nasser Pangandaman Jr., mayor of Masiu, Lanao del Sur, and his golfing companions and armed bodyguards. The victims, Delfin de la Paz and his family, said the Agrarian Reform secretary witnessed the incident at the Valley Golf Club but did not stop his son and their bodyguards from attacking the victims.

De la Paz filed the complaint immediately after the incident on Friday with the Antipolo police, who said the charges, including child abuse, would be filed on Monday.

Breach of etiquette

De la Paz said the incident started when the Pangandamans broke golf etiquette by playing out of turn and over-taking the De la Paz family at the South Course of the Valley Golf and Country Club.

In an interview, De la Paz, 56, said he and his two children—daughter Bambee, 18, and son Bino, 14—were playing golf and were on Hole No. 3 when two golf carts bearing the Pangandamans and their friends overtook them.

Aside from the Pangandamans, the group also included Paysal Abdulaa, Mohammed Hussein, Abdan Pacasuna, Rene Maglaque and Arnel Astacio.

Dela Paz said he complained to the marshal and when the two groups caught up with each other at the tee house on hole No. 5, an altercation ensued.

De la Paz said that at the height of the altercation, Nasser Jr. suddenly attacked him and his son, punching and kicking them and shouting: “Hindi mo ba ako nakikilala? (Don’t you know me?)”

Bambee de la Paz, who witnessed everything, said the younger Pangandaman continued to attack even when his brother was already on his knees pleading for him to stop.

Bambee, in an e-mail to friends, said they decided to stop playing and retreated to the clubhouse to seek medical attention, but their attackers followed them there. This time joined by their bodyguards, the Pangandaman group again attacked father and son. Bambee said two of the mayor’s bodyguards even pulled out their guns.

She said that while Secretary Pangandaman did not participate in the attacks, he did not lift a finger to stop his son and his companions from beating the victims. None of the golf club’s security guards and managers tried to stop the beating.

‘Golfers are decent’

Dela Paz’s 14 year-old boy suffered various facial, head and back injuries due to the blows he received.

“This is a golf course. I have been a golfer all my life and I have never seen anything like this,” Bambee said. “And I though golfers were decent people. You would think politicians were decent people. I guess not.”

Bambee and Bino de la Paz are both outstanding junior golfers. Bambee is on vacation from the University of Cincinnati where she is a golf scholar. Bino is one of the top golfers in his age group.

Efforts to reach Secretary Pangandaman for comment yesterday proved fruitless. His cell phone was off. The public information officer of the Department of Agrarian Reform promised to call the Inquirer as soon as he got in touch with the secretary but he had not done so at press time Saturday.

When President Arroyo appointed former Marikina Mayor Bayani S. Fernando chairman of the Metro Manila Development Authority (MMDA) on June 14, 2002, she said in her announcement: “When I called Bayani, I said, `BF, what you did for Marikina, you must do for the whole country.’”

That statement seemed odd at the time, considering that Metro Manila is definitely not “the rest of the country.” What she meant by that statement became clear only about six months later when she appointed him public works and highways secretary (on a concurrent capacity) on January 9, 2008.

Apparently, the President—impressed by his accomplishments as Marikina mayor—had high hopes that Fernando, an engineer, would be able to work his magic on a nationwide scale. Thus, she gave him the public works portfolio in addition to his assignment as MMDA chairman.

(As subsequent events would show, it did not take long before he had to relinquish the much-coveted Cabinet job. For reasons the public has not been able to divine, Fernando seems perfectly at home in his multibillion peso fiefdom that the MMDA is.)

Nobody, of course, could fault the President for openly admiring Fernando, who had racked up quite an impressive pile of accolades for himself and Marikina during his stint as Marikina mayor. After all, the residents of Marikina themselves seemed quite satisfied with him. They elected him mayor for three straight terms from 1992 to 2001. They also elected in his place as mayor his wife, Maria Lourdes C. Fernando, when he had reached the three-term limit set by law.

In 1994, Marikina was adjudged best local government unit in the National Capital Region. The other major accolades the city got under his leadership included the following: Best Local Government Unit in the Philippines, by the National Heritage Award (Pamana ng Lahi) in 1995; Most Outstanding City in 1997; and Best Managed City 1999.

But to several people who have had the chance to observe him closely or deal with him and the city government of Marikina, Fernando is hardly the paragon of virtue and excellence in public service that he paints himself to be.

At the Office of the Ombudsman are several graft and administrative cases filed against him and practically the entire city council for irregularities involving hundreds of millions of pesos worth of contracts for infrastructure projects, and purchases of materials and equipment.

In two two separate cases, complainants Teodolfo T. Macarilao and Dominador M. Domingo have cited Fernando for alleged irregularities in connection with the award of four contracts for the construction of school buildings in various barangays. These projects were allegedly awarded to different contractors in violation of the Article 1B 10.4.1 of the implementing rules and regulations of Presidential Decree 1594.

Fernando also hired a consultant unnecessarily in connection with the construction of Marikina’s Hall of Justice and the City Jail building.

Complainants Oscar L. Reyes and Estrellita Regellana, in another case, denounced Fernando and other Marikina key officials for alleged irregularities in connection with two contracts, one amounting to P31.65 million for the construction of a three-story, 36-room classroom school building in Fortune Parang Parang; and the other one, which was worth P59.6 million, for the construction of the justice and jail buildings.

In a separate case, complainants Mario F. Fontanilla Sr. and Edmundo B. Mission denounced irregularities in three city construction projects in different barangays “with a total project cost of P96 million, disclosed deficiencies totaling P5.737 million, including liquidated damages not imposed.”

In this case, which implicated city engineer Alfonso P. Espiritu; Melvin A. Cruz, city administrator; and Councilor Larry Punzalan, just to name a few, statements of work accomplished and certifications of completion and acceptance were all falsified.

In another case, complainants Romulo G. Borja and Arcangel L. de la Paz, denounced Fernando and several others in the city government for alleged irregularities in the procurement of some P5 million worth of “various deformed bars.” The procured bars were not subjected to material testing as required by Commission on Audit rules. The purchase was overpriced, as borne out by test results of samples taken from the City Central Warehouse.

Complainants Macarilao and Domingo filed yet another case with the Ombudsman against Fernando for irregularities in the purchase of P19.99 million worth of personalized notebooks and P1.99 million worth of schoolbags. These items were allegedly paid for with funds taken from the city’s Special Education Fund (SEF), which is not allowed, and therefore illegal. The schoolbags were also found overpriced.

Complainant Alberto S. Lamayo, president of the Federation of Marikina Public Schools Parents and Teachers Associations, also denounced Mayor Bayani F. Fernando in connection with a P100 million loan taken out by the city from the Philippine Veterans Bank. By deducting P25 million a year from the SEF to amortize the loan for five consecutive years, Fernando allegedly violated sections 272 and 100 of Republic Act 7160, the Local Government Code, governing the utilization of the fund, as well as the creation of indebtedness by the city as provided for in sections 296 and 313 of the same Code.

These specific cases are among those that have gathered dust at the Office of Ombudsman since 2001. They are apart from the cases involving irregularities “in community mortgage programs in Marikina City” that have also been filed with the Ombudsman and are still awaiting resolution. It is in the mortgage programs case that Fernando’s wife, Mayor Maria Lourdes C. Fernando, is also named along with dozens of respondents, including key officials of the city government.

The criminal cases of graft are apart from the administrative cases for grave misconduct and abuse of authority that the respondents are facing.

We can only surmise that these cases have not been allowed to prosper because Fernando, until now, seems to be doing well—in the eyes of the Arroyo administration. Nowadays, it seems, it doesn’t matter what the public may think about the MMDA chairman. What only matters is what GMA thinks about him.

Militants deface Bayani Fernando posters in QC

MANILA, Philippines - Militants resumed Sunday their spray-painting of posters and tarpaulins of Metropolitan Manila Development Authority (MMDA) chairman Bayani Fernando, focusing their efforts in Quezon City.

Radio dzBB's Allan Gatus reported that members of Kadamay defaced the posters of Fernando, including those calling for discipline and those congratulating him for winning a TV singing contest.

The group concentrated its activities in some areas of Quezon City, including Commonwealth Avenue, Epifanio delos Santos Avenue (EDSA) and Kamuning.

Thank you for making Metro Manila beautiful. Sana kinuha nyo na lang yung mga posters at itapon.

Also, the group said it is planning a protest march to Mendiola Bridge against Fernando scheduled Dec. 1 and 2.

Militants accused Fernando of violating human rights with the MMDA's clearing operations targeting sidewalk vendors.

But a Q-11 television report Saturday night quoted Fernando as saying the vendors who are the targets of clearing operations should pay legitimate rent in markets instead of protection money to syndicates that let them place stalls in the sidewalk. - GMANews.TV

Metropolitan Manila Development Authority Chairman Bayani Fernando is not letting the All Saints’ Day pass without a pitch for the presidency.

This was the reaction of Parañaque Rep. Roilo Golez yesterday after seeing Fernando’s posters and tarpaulins at the Loyola Memorial Park in Marikina City whose mayor, Marides Fernando, is the wife of the presidential aspirant.

Golez said he was at the memorial park to pay his respects to his father, sister and parents-in-law only to see the tarpaulins of Fernando all over the place.

“Dito ako sa Loyola Marikina...dalaw sa puntod ng father, sister and parents-in-law. Yong gate ng Loyola, tadtad ng tarpaulins ni Bayani (Fernando). The guy is really running a shameless campaign,” Golez said in a text message sent to House reporters.

Golez has filed a case against Fernando before the Office of the Ombudsman in connection with alleged misuse of public funds.

Golez posited that Fernando has diverted flood control funds for Metro Manila to the printing of his tarpaulins and to the construction of the U-turn slots. The Ombudsman has yet to act on the charges.

Good news for bus drivers: No speed limit along EDSA

The sky is the limit in EDSA!

Chairman Bayani Fernando of the Metropolitan Manila Development Authority said Wednesday that the agency has not imposed a speed limit along EDSA, the main highway across Metro Manila.

"There's no specific speed limit," Fernando told ABS-CBN's morning show, "Umagang Kay Ganda," adding that the MMDA is still in studying traffic along the longest highway in the capital region.

He said in a highway like EDSA the speed limit is usually 100 kilometers per hour. "That's really fast, but that is the usual speed limit on highways."

Before dawn Tuesday, Dr. Francisco "Toto" Sarabia burned to death after a racing bus crashed into his car, which instantly exploded during the impact.

Footage taken by ABS-CBN News on Wednesday dawn showed speeding buses and private cars along EDSA. It was as if the tragic road accident that killed the doctor did not happen.

Sarabia's Mercedes Benz was following a bus, which was parked outside the loading and unloading bay of EDSA in front of Camp Aguinaldo, when a speeding Joana Jesh bus crashed into it.

The Mercedes Benz's gas tank exploded and created a blaze that totally gutted the vehicle and killed the doctor. The doctor's legs were reportedly cut off at the impact and he was already unconscious when the fire consumed his body.

LTFRB Chairman Thompson Lantion said the agency issued the suspension pending the investigation on the possible neglect of the bus company, which could have led to the freak road accident.

Rosales: RH bill a matter of ethics, not just population

Manila Archbishop Gaudencio Cardinal Rosales spoke on Sunday about the controversial House Bill 5043, or the Reproductive Health Bill, and said that the Catholic Church cannot stay on the sidelines on the issue. He said the Church should have a say on the matter since ethics, not just the population, is involved.

Maging ang economy ay moral issue," Rosales said during a visit to Baseco, Tondo in Manila, where he led a Mass for the urban poor.

The statement came amid the latest Social Weather Systems (SWS) survey which showed 71 percent of respondents, or majority of Filipinos, favor the passage of the bill.

In the latest SWS survey conducted September 24-27, some 68 percent of the respondents agreed that there must be a law that obliges the government to distribute legal contraceptives like condoms, Intrauterine device (IUD), and pills to people who want to avail themselves of these.

The remaining 15 percent disagreed while 16 percent were undecided.

“It is undeniable that the Filipino people are the ones demanding information and services,” Benjamin de Leon, president of The Forum for Family Planning and Development (The Forum), said in a press conference.

In the survey, the respondents were asked to agree or disagree with three statements: 1) The use of legal contraceptives like condoms, IUDs and pills can aslo be considered as abortion; 2) There should be a law that requires government to distribute legal contraceptives; 3) If family planning would be included in the curriculum, the youth would be sexually promiscuous.

Out of the 1, 500 respondents, 50% do not agree that the use of contraceptives is a form of abortion, 68 percent agree that there must be a law that requires the government to distribute legal contraceptives and 54% disagree that including family planning in the school curriculum would lead the youth to be sexually promiscuous.

The respondents were composed of 81 percent Catholics and 19 percent non-Catholics; 50 percent are males and 50 percent females; eight percent come from classes ABC, 64 percent from class D and 27 percent from class E.

Meantime, the group Pro-Life questioned results of the latest SWS poll.

They insisted the survey, which showed strong public support for the reproductive health bill, is a result of manipulation.

However, Pro-Life president Ed Soretta said they don't plan to request for the conduct of another survey, adding the issue is one of morality and not population.

Lagman added the group cannot accept the fact that the bill is already making progress in the Lower House.

Rail loop stalling blamed on Fernando

THE Light Rail Transit Authority is taking to task Chairman Bayani Fernando of the Metro Manila Development Authority for delaying the P6.4-billion billion government-financed project to connect the Metro Rail Transit on Edsa and the Light Rail Transit Line 1.

LRTA Administrator Mel Robles said the MMDA was yet to issue permits to contractor DMCI-First Balfour, including approvals for changes in the infrastructure.

“The delay is not of our making. It’s actually the MMDA and Chairman Bayani Fernando who are holding up the construction,” he told reporters.

“We have already broken ground for the construction work last June. But the MMDA has failed to issue excavation permits because of some issues it raised about the railway construction design.”

The project will add 5.4 kilometers to the MRT line from its North Avenue station in Quezon City to link up with the LRT Line 1 terminal in Monumento, Caloocan City.

Robles said Fernando wanted the height clearance of the elevated railway section changed from the planned 5 meters to 14.7 meters.

Flamboyant as he is, Metropolitan Manila Development Authority (MMDA) Chairman Bayani Fernando was almost reduced to smithereens during the late Friday night deliberation on his agency’s budget at the House of Representatives.

The interpellation on MMDA budget was actually one of the much awaited episodes of the recently concluded House budget debates and minority solons Senior Deputy Minority Leader Roilo Golez and Rep. Abby Binay did not disappoint the audience of lawmakers and the people in the gallery.

Using a powerpoint display of pictures and documents, Golez gave a blistering critique of Fernando’s controversial MMDA projects.

Saying MMDA personnel have been involved in the theft of the LRT vertical clearance post and with their headquarters fronting Edsa reminiscent of a junkyard, Golez said the MMDA tarpaulins should be directed to themselves instead of the public.

“Fernando’s color in Marikina is pink and he is using government funds to make Metro Manila a giant pink poster for his political ambition,” Golez said.

NEW YORK (Reuters) - The credit crisis has shattered U.S. consumers' faith in financial institutions, including a stunning loss of confidence in the Federal Reserve, and that is likely to trigger the biggest drop in consumer spending in more than three decades and a deep recession, according to a survey released on Friday.Fifty-seven percent of U.S. consumers surveyed reported having lower confidence now in the Fed than five years ago, including 29 percent who said they had "a lot less" confidence, the Reuters/University of Michigan Surveys of Consumers said.

Compare that with confidence in the Fed after the 1987 stock market crash. Then, after U.S. stocks fell more than 20 percent in a day, just 19 percent of consumers said they had less confidence in the U.S. central bank, including only 7 percent who said they had "a lot less" confidence.

Faith in banks, thrifts, brokers and mutual fund companies took hits across the board, the new report showed. Only credit unions were spared from consumers' fast-evaporating confidence in the financial system.

"This loss in confidence will cause consumers to accelerate their spending cutbacks and those reductions are likely to persist through most of 2009," survey director Richard Curtin wrote in the report. "These data indicate that a longer and deeper recession is now likely."

The loss of trust in the Fed comes as the U.S. central bank, working with the Treasury Department and other central banks around the world, scrambles to unclog key credit markets that provide the basic plumbing for the global economy.

So far, however, those efforts -- ranging from massive liquidity injections to the financial system, to a $700 billion bank rescue fund approved by the U.S. Congress, to coordinated global interest rate cuts -- have met with resounding votes of no confidence by investors.

Stock markets around the world have crashed through early October, and the U.S. market has now fallen for seven straight sessions, wiping out 21.8 percent of the value of the Standard & Poor's 500 index. That is the U.S. benchmark's worst stretch since the October 1987 crash, with more than $2.2 trillion in market capitalization wiped out since September 26, the last day U.S. stocks rose.

U.S. consumer spending is expected to decline through the first half of 2009, with total personal consumption expenditures falling by 0.5 percent in 2009 compared with 2008, the survey's director wrote.

Consumption has fallen in only two of the past 50 years -- in 1974 by 0.8 percent and in 1980 by 0.3 percent.

"In historical perspective, this is quite a negative outlook," Curtin said. "The longest period of decline in consumption during the past half century was four quarters, which the current downturn is expected to equal."

"To be sure, the current forecast is not comparable in any way to the depth or the length of the downturn from 1930 to 1933, when consumption spending fell on average by 4.9 percent per year for four years," Curtin said.

Among other survey findings, two-thirds of U.S. consumers see the credit crisis significantly hurting the economy, while one in five households expects a large negative impact on their personal finances.

Further, a majority of U.S. consumers have altered spending plans due to the crisis, with nearly one in three anticipating a substantial cutback.

Access to consumer credit for purchases is an increasing problem. Ten percent of households surveyed said they had problems obtaining credit during the past year.

"In response to questions about buying conditions for a wide variety of purchases, consumers much more frequently mentioned that tighter credit conditions was a cause to postpone purchases," Curtin wrote. This was in addition to growing uncertainty about future jobs and incomes.

He said the attack on him is just part of a series of calculated media campaigns designed to discredit him because the evolution of Metro Manila into a vibrant and livable metropolis by 2010 is now well within sight.

Golez also refuted the statement of Lakas official Ed Malay who said the Parañaque solon is in no position to claim that no Lakas member is taking Fernando seriously.

In a text message, Malay, a known ally of former President Fidel Ramos, chastised Golez for issuing statements as if he is speaking in behalf of Lakas.

“Rep. Golez can’t say (Chairman) Fernando is not taken seriously by his partymates in Lakas. How would he know that?” Malay said in his text message.

“He should not speak of our party since he doesn’t know what’s going on within us. Talking to two or three Lakas solons does not represent the sentiments of the entire party.”

But Golez answered Malay, saying he is, in fact, in a better position to pulse the sentiments of solons identified with Lakas.

“Contrary to his claims, I am in a better position to know the sentiments of Lakas congressmen. I am with them every session day and only one congressman has spoken positively of Fernando,” Golez said, adding

“I would rather not mention the unkind remarks.”

Not everyone, however, is as appreciative of Fernando's take-no-prisoners stance against sidewalk vendors, squatters and other inhabitants of urban poor communities.

Last week, a group of young militants labeled the MMDA chair a "berdugo" (executioner) as they picketed the MMDA offices to protest the agency's policy on street hawkers and illegal settlers.

The protesters belonging to the urban poor group, Kalipunan ng Damayang Mahihirap, assailed the MMDA's operations around Metro Manila, which they said displaced many of them from their homes and made them lose their only source of a decent income.

Such criticism has not perturbed Fernando, who has said in several interviews that more city residents prefer his strict management practices in preserving order in the metropolis.

According to House deputy minority leader Rep. Roilo Golez, he moved to defer the MMDA budget on the note of Fernando’s statement that there was no speed limit on Edsa.

“I moved to defer, and this was carried, the consideration of the budget of the MMDA when Chairman Fernando said at a formal hearing that there was no speed limit on Edsa and that he was even encouraging motorists to go as fast as they can,” Golez said yesterday.

Golez added it was reckless and irresponsible on the part of the MMDA chairman, who is tasked with managing Edsa traffic, to say there was no speed limit on Edsa.

“If drivers heed his statement, Edsa would become a death avenue with all the resulting deadly collisions,” Golez said.

In spite of the “many unanswered questions on flood control, travels and tarpaulins,” the hearing was moving smoothly prior to that statement.

The move to defer the MMDA budget started when Fernando refuted Golez’ s statement, in the course of the budget hearing that touched on several issues, including Fernando’s use of several police escorts, the huge tarpaulins, the U-turn slots and the MMDA’s use of flood control funds, that motorists should comply with a 60-kph speed limit along Edsa.

Fernando said there was no such limit and that he is encouraging motorists to go as fast as they can on Edsa.

“Actually, it’s more than that (60 kph), your honor. They can run as much as they can. We have to speed up the vehicles (along Edsa),” Fernando told members of the House appropriations committee.

Golez said he was willing to withdraw his motion if Fernando takes back his statement and tell the lawmakers that he was only joking.

“No, I’m not kidding your honor. I encourage motorists to move faster (along Edsa),” Fernando answered back. On that note Rep. Abigail Binay seconded Golez’s motion.

“I move to defer because this budget may be used to promote traffic accidents on Edsa. It’s a reckless, irresponsible statement coming from the MMDA chief,” Golez said.

“If drivers heed his statement, Edsa would become a death avenue with all the resulting deadly collisions.”

Golez maintained the statement, coming from the MMDA chief, would have dire implications.

Muntinlupa City Rep. Ruffy Biazon, who heads the sub-committee on appropriations which heard the MMDA budget yesterday, concurred with Golez and Binay.

Biazon said “the budget deserves to be deferred.”

Earlier at the hearing, lawmakers also lamented Fernando’s failure to produce a copy of an approved resolution coming from the Metro Manila Council — composed of 17 mayors — that is required before the MMDA budget is discussed.

Upon the warning of Biazon that the committee will not allow another failure to bring the resolution, Fernando said he would try his best.

“Best efforts, your honor. I cannot promise (that we will deliver), but we will exert efforts. We will try to give that in time for plenary deliberations your honors,” Fernando said.

“We do hope that your best will be good enough. But next time we will not allow that,” Biazon said.

Fernando could not likewise provide lawmakers a breakdown of the flood control funds and projects for each local government unit in Metro Manila.

Fernando told lawmakers that it might take him “too long” to produce documents pertaining to the flood control funds.

Bayani justified his hiring of police escorts by saying that the cops accompanying him on his travels are traffic enforcers who attend to traffic problems that they may encounter along the way.

"We manage the traffic in Metro Manila, and my escorts are traffic enforcers," Fernando replied.

Fernando replied by saying drivers can even go beyond 60 kilometers per hour because the MMDA wants as little traffic congestion as possible.

"That to me is a very reckless, irresponsible statement on the part of the MMDA chairman," Golez said.

Golez said he would withdraw his motion to defer if Fernando says he was kidding about his statement that there is no speed limit along EDSA, but the MMDA chairman replied, "I'm not kidding."

Earlier, the opposition solon also grilled Fernando on other rules that the MMDA chairman supposedly violated, particularly in connection to the MMDA tarpaulins strewn across Metro Manila highways.

Citing MMDA Regulation 04-004 signed by Fernando on Sept. 2, 2004, Golez pointed out that it was unlawful for any person or corporation to install or display billboards along major thoroughfares and other roads without the approval of the MMDA and permits from local government units (LGUs) concerned.

He then questioned the MMDA chairman if he is violating the regulation which he himself signed.

Fernando defended the posting of the MMDA tarpaulins, which carry his image, by saying they are posted on national highways that LGUs "understand" to be under MMDA jurisdiction.

"These are on national highways which are under our jurisdiction," said Fernando. "We have an understanding with LGUs that national highways are under MMDA."

"Somehow I have administrative prerogatives," the MMDA chairman added.

Fernando, who had publicly announced his intention to run as president in the 2010 elections, also said there is nothing political about the tarpaulins, which bear road safety reminders, except "perhaps my picture."

The subcommittee hearing on the MMDA's proposed budget was almost deferred at the very beginning of the hearing when, upon the inquiry of Golez, Fernando admitted that the MMDA 2009 budget proposal has not been approved by the Metro Manila Council and that this has been the "practice" for a long time.

Golez had earlier pointed out that under Republic Act 7924 or "An Act Creating the Metropolitan Manila Development Authority," the MMDA must first secure the Metro Manila Council's approval of the proposed budget before presenting it to Congress.

The opposition lawmaker conceded to hearing the budget, however, after Fernando assured that they would give their "best effort" to obtain the approval of the Metro Manila Council before the plenary hearings on the 2009 budget.

Uniforms overpriced, metro aides complain

Street sweepers from the Metro Manila Development Authority are considering filling a graft case against officials of the agency involved in the procurement of allegedly overpriced uniforms.

Some 3,000 street sweepers or metro aides, who are members of the MMDA employees’ union, Sakamay, claim that the uniforms are not only overpriced but are of poor quality.

They refused to accept the uniforms until the MMDA management acted on their complaint.

The MMDA officials “claimed that they have taken into account our complaints about the uniforms they would be distributing to us... but they have pushed through with it, disregarding our questions on the quality of the gear,” said Luisa Estacion, Sakamay secretary-general.

Estacion said some of the equipment like rubber boots, thongs, raincoats and belt pouch are regularly issued to metro aides and should not be deducted from their P4,000 annual clothing allowance.

Estacion also questioned why jogging pants were issued to the sweepers instead of regular pants.

She said the sweepers’ clothing allowance used to include a long-sleeved, collared shirt and pants. Now the agency gives them garterized jogging pants, an ordinary shirt and an armband.

She also said that the clothing issued to them only costs P3,202, P798 short of the P4,000 annual clothing budget.

The MMDA started distributing new uniforms to its personnel last January 15. Only the street sweepers’ group refused to accept the uniforms.

The group also said the contractor who made the uniforms was endorsed by one of Chairman Bayani Fernando’s consultants.

Edison Fainsan, the MMDA general manager for finance, dismissed the claims of the group and said that the procurement of uniforms went through the regular process and competitive bidding.

“We are willing to open our books in order to prove that there’s no irregularity in the procurement of the new uniforms and that it was made in a very transparent process,” Fainsan said in an interview

MANILA, Philippines -- The filing of appropriate charges before the Office of the Ombudsman against Metro Manila Development Authority (MMDA) chairman Bayani Fernando has been formally sought by a lawmaker at the House of Representatives.

Deputy Minority Floor Leader Roilo Golez, in a letter to Ombudsman Ma. Merceditas Gutierrez, requested an “investigation of and the filing of appropriate charges, if warranted” against Fernando for alleged misuse of funds and other irregularities.

Golez cited the alleged non-payment of clothing allowance of MMDA employees for two years, destruction of government property with the “dangerous and unsightly” three-lane U-turn slots, violation of the MMDA regulation on billboard and advertising signs, and alleged expensive trips here and abroad purportedly to improve the performance of his office.

Golez cited the “massive tarpaulin campaign” of the MMDA featuring the giant photos of its chairman and the installation of pink traffic signs purportedly in preparation for 2010.

The MMDA chief has openly declared his intention to run for president in 2010.

“The MMDA chairman has misappropriated the color pink for non-civil defense purposes, thus jeopardizing future civil defense activities,”
Golez said.

“It is public knowledge that pink is the political color of the Mayor of Marikina, the wife of the MMDA chairman, and is therefore for the chairman’s personal political ends and not for the public interest,” he said.

"So we’re just on the border line of passing. So we have to raise it to 70% so that our AFP can be effective in protecting our civilian communities in Mindanao," he added.

"The expectations are high, the demands are very high on them to protect these communities. They will be spread out, they need mobility, they need firepower. They lack helicopters, they lack airplanes, bullets, trucks, hand-held radios. At that time when I was still at DND, they still lacked 12,000 hand-held radios," Cruz said.

MANILA, Philippines — If there is one public official in our country today who does his work seemingly without regard for the political consequences, that person has to be Bayani Fernando, the current chair of the Metropolitan Manila Development Authority (MMDA). In a just society, he would be a model public servant. But in our kind of society, he can only be the blind, uncaring agent of the powerful.

BF, as he is popularly known, is ironically, for the same reason, the modern Metro Manilan’s folk hero. For the city’s most persistent problems –illegal encroachment on public space, traffic gridlocks, rampant criminality, flooding, urban blight, etc. — he finds solutions that are, at one and the same time, capricious and ingenious, impulsive and experimental, outlandish and generally effective. The upper and middle classes hail him as modernity’s champion, and think of him as the kind of president we need. But I doubt that he will ever win an election outside of Marikina City, where he was mayor for many years.

For BF is also possibly the Filipino poor’s most hated figure. This is understandable. To him belongs the unenviable job of dealing with all the illegal improvisations that make up the typical life of those who are forced to spend the greater part of their time trying to survive. BF is right in the frontline of the class conflict that rages daily in our divided society. And he is staunchly on the side of power.

While his political bosses may pay lip service to the needs of the poor even as their policies systematically oppress them, BF has no choice but to face the poor as if they were a perpetual nuisance, in accordance with his assigned role as the hatchet man of an unjust property system.

In this capacity, he must remain blind to the larger societal context of the problems he is assigned to fix. He cannot propose long-term solutions that touch on the structural inequalities from which flow all the problematic outcomes of mass poverty. He is effective precisely because he treats the symptoms, and remains unmindful of the profound social illness that produces them. In countless media appearances, BF speaks of the problems of the city in such folksy commonsensical terms that he leaves you wondering how someone like him can be so insensitive in his dealings with the poor. You expect this lack of empathy to come from a disengaged technocrat who cannot see beyond his theory. It is shocking to find it in a practical man like BF who has lived among the masses. Is it possible that he thinks he knows the poor so well that he actually believes there is no way of dealing with them except by acts of toughness?

A few years ago, he stopped illegal vendors from plying their trade on sidewalks by ordering his men to spray kerosene on the goods they were selling. In this manner, he reasoned, there is no way they can recover their investments. He confiscated their carts, and detained those who persisted in occupying the sidewalks.

The other day, I heard him on radio talking about the demolition of shanties along “esteros” [creeks] and under bridges that impede the flow of rain water and cause flash floods. Asked if there were relocation sites to which the affected families could be transferred, BF had a ready reply: “We cannot reward these lawbreakers by giving them homes.” He wants to send them back to the provinces where they came from. One might wonder where such attitude is coming from. But in fact it is a sentiment that is silently held by many Filipinos who do not have to live dangerously along river banks or pitch their shanties inside cemeteries.

It is difficult not to appreciate BF’s stubborn ideas about how to make the city livable. To him it is all a matter of teaching people how to live in a modern society. There is a lot of truth in this, but it is not the whole story. It omits the one crucial element that determines the character of most of our social problems as a nation: mass poverty.

You cannot have a well-ordered city if nearly one-half of your residents have no regular jobs, no decent homes, and no bright future to look forward to no matter how hard they try. Law-abiding citizens will not thrive in a society in which the very structure of opportunity has collapsed for the many. They will be forced to improvise in order to survive. They will put up their homes wherever they can so they can be close to schools, hospitals and places of work.

You cannot tell people constantly on the verge of starvation to stay away from garbage heaps. You cannot tell them that scavenging is an unworthy way to earn a living. You have to show them that a better way is within their reach. BF knows this. He was irked by the sight of grown men stopping in the middle of the streets to urinate behind the doors of their taxis or on the tires of their jeepneys. He tried shaming them for acting like stray animals, but to no avail. What finally put a stop to this uncivilized habit were the pink urinals he put up on Metro Manila’s sidewalks. If you build public toilets, people will relieve themselves decently. If you build them proper homes, they will voluntarily leave the esteros.

People in general are not unreasonable. They may stall, negotiate and try to assert the primacy of their interest — but such behavior is pretty much distributed across social classes. Poverty is certainly no excuse for recalcitrance. But even under a rule of law, the MMDA’s forcible demolition of poor people’s shanties, leaving them without a roof over their heads, constitutes an unspeakable atrocity.

The Philippines is falling behind most of its Asian neighbors due to its poor
infrastructure. Hence, the attempt of the present administration to increase (the
historically-low) investments in infrastructure – in the transport sector, more specifically
- is to be lauded.
But spending for poorly-conceived, mediocre, and ill-designed projects will only
increase the number of poor infrastructure, rather than raise our country’s
competitiveness. The construction of elevated U-Turns in Metro Manila belongs to that
genre. Instead of building world-class structure, the MMDA is spending hundred of
millions of pesos on a structure that violate national and international highway
standards.
Perhaps, the original plan for the intersection may have been over-designed. In the
world of professional practice, the same issue can only be resolved through Peer
Review, and not by sheer “political will.” An “over-designed” structure is more tolerable
in the long run than an ‘under-designed” one. Also, a peer review process would have
shown that the construction cost of a straight viaduct is lower than a curved one, for
the same length and number of lanes, aside from having a lesser number of traffic
hazards. Strangely and unfortunately, in this case, there is also no duly-licensed “Peer”
to talk about.
The objective of grade separation at major intersections is to achieve maximum road
capacity (or passenger throughput) per lane. Gaining “pogi points” is not an explicit
objective in building of transport infrastructure. This can not be achieved by the
elevated U-Turn scheme for two basic reasons: (a) a roundabout way can never be
shorter or faster than a straight line from point A to point B, (b) the potential conflict
points between vehicular movements have not been reduced. The high-volume
through-traffic get intermixed with local, low-volume, slower-speed, and left-turningtraffic;
thus, reducing the overall flow to the least common denominator – especially
severe during peak hours. Vehicles can only be as fast as the slowest ones in front of
them.
Bragging that the structure is the first of its kind in the world may be a cause of pride
for its proponent. It is, however, a cause of shame for Filipino civil engineers who are
supposed to be responsible, by law, for this kind of structure but were not involved in
the first place. A mediocre design that ignores fundamental rules of road safety is not
something Filipino civil engineers (as it would be wrongly ascribed to the profession as
a whole) – or for that matter, patriotic Filipinos - can be proud. Neither is it the path to
progress.
The Philippines can only move into the faster lane of development and progress – if it
builds the right infrastructure in the right way and under the exacting yardstick of
globally-accepted engineering standards.

An activist environmental group is not convinced at all in the Metro Manila Development Authority's (MMDA) claim of cleaner air. Clemente Bautista, national coordinator of the Kalikasan People's Network for the Environment (KPNE) branded MMDA Chairman Bayani Fernando's claim as pure air.

Fernando declared that there was a 50-percent drop in the air pollution level of Metro Manila due to the massive sweeping and vacuuming of roadways initiated by the MMDA.

Bautista said, "Maybe the ever-arrogant Chairman is hallucinating from the polluted air he breathed in EDSA or just campaigning for 2010."

The group pointed out that they found no scientific study or data showing that air pollution levels in Metro Manila have dropped. "There is no recent air quality status report, which just goes to show that clean air monitoring in the country is ineffective," said Bautista.

The KPNE said that even the technical paper published by the World Bank concluded that average Total Suspended Particulate (TSP) concentrations of Metro Manila are frequently five times higher than the World Health Organization Air Quality Guidelines. Higher than standard TSP means higher pollution. TSP is used to measure particulate matter (PM) present in air. PM is the generic term used for a type of air pollution that consists of complex and varying mixtures of particles suspended in the air.

Former Ilocos Sur governor Luis "Chavit" Singson, a losing senatorial candidate of the administration in 2007, confirmed Saturday that he has been appointed by President Arroyo as deputy national security adviser (NSA).

Singson told ABS-CBN News Channel that he was informed by Executive Secretary Eduardo Ermita about the appointment on Friday.

Asked what he can contribute as deputy to NSA Norberto Gonzales, Singson said he will be "concentrating on our Muslim brothers in Mindanao."

Pacquiao is reportedly interested to run for a congressional seat either in General Santos City or in nearby Sarangani Province. He ran and lost for the 2007 congressional post opposite Darlene Antonino Custodio, who is now on her third and last term.

Puno is Kampi’s chairman while Pacquiao is currently the World Boxing Coucil lightweight champion slated to fight Oscar de la Hoya on Dec. 6 at MGM Grand Casino in Las Vegas, Nevada.

One of my favorite blogs these days is something called “Mga Side Comments Ko” on Blogspot. The site has a map which shows where probably the most thick-faced official of this government has been lately, under the heading “Where in the Philippines is Bayani Fernando?”

Clicking on the face of the Metro Kwago (as another blogger calls the owlish-looking chairman of the Metro Manila Development Authority and early-bird presidential candidate) will lead a visitor to the map—which is supported by photographs of places around the country where Fernando has been.

Bayani’s itinerary has been backbreaking: Ilocos, Zambales, Bulacan, Quezon, Aklan, Iloilo and Davao are some of the locations where the supposed chief traffic aide of the metropolis has been recently. In the photographs, Bayani is shown glad-handing the locals, dancing during their town fiestas, distributing relief goods and generally spreading his luridly pink-and-baby blue largesse throughout the country.

In nearly all the photographs, Bayani is escorted by official vehicles of the MMDA sporting red government plates —giving the lie to the MMDA chairman’s claim that he is using his own resources to campaign (illegally, it must be added, since he still has not resigned) for the presidency two years before the elections. Even assuming that he is, as he claims, using his own money for the plywood boards and other stuff that he’s donating all over, what about the cranes, trucks and various other vehicles that he’s been using to deliver them?

Does Bayani own all these vehicles, as well? And does Bayani think that just because he’s doing all these things outside Metro Manila, no one will notice?

The abuses committed by Bayani Fernando boggle the mind, and yet the man thinks he is being persecuted. To the House of Representatives, for instance, he has replied that he will not appear at a congressional investigation of his activities because the lawmakers who are accusing him of wrongdoing are “politically motivated.”

This is just the latest of Bayani’s transgressions, that of ignoring a Congress summons without even the benefit of an executive gag order from his boss, President Gloria Macapagal Arroyo. Where most government officials would quake in fear of appearing before a congressional investigation, Bayani actually thinks he can get away with this cavalier dismissal of the House invitation on the grounds that his interrogators have a political motive.

One of Bayani’s most treasured myths about himself is that he is all about discipline. And yet, given the many and repeated transgressions of the MMDA chairman, you have to wonder who will discipline him.

Bayani has run afoul of the law so many times and yet he is allowed to thumb his nose at anyone who dares cross his path. He can even go on a television talent show and claim that he wants to win because he is raising funds for his election campaign in 2010—and no one even asks anymore if this blatant fund-raising by a sitting government official is illegal or not.

WTF! talaga sinabi nya yon!?! sorry hindi na ako nanonood ng local TV programs. Naiinis lang ako.

He has crossed swords with an entire Cabinet’s worth of government agencies and nearly all of the mayors of Metro Manila (who supposedly are his bosses and funders), and yet he goes on his merry way—disregarding laws, ordinances, human rights and simple courtesy as he barrels his way through with his pink-and-blue army of traffic terrorists, mulcters and bus-jackers, sidewalk-vendor scourges, squatter demolishers and sticker-and-tarpaulin plasterers.

Jojo Robles, ano sa palagay mo at bakit gustong tumakbo ni BF as president of the Republic of the Philippines? Power, pera, attention, para ba maabswelto sa mga kaso?

No one has asked Bayani to present an audit of his expenses, to show which funds are his and not his to spend, and which was spent where and how much. No one has filed charges against Bayani for ordering the illegal confiscation of property in the form of the buses his men take over or the wares of the sidewalk vendors that they grab and never return.

Even the usually quick-on-the-draw human rights groups have not taken up the case of Bayani’s lightning demolition of squatter shanties, nor have they challenged his explanation that it’s not his job to relocate squatters, only to demolish them. No real opposition has been encountered by the government employees who do nothing but put up his tarpaulins and stick his stickers—even if the taxpayers cough up the money for their wages. No official inquiries have been made about his questionable infrastructure projects like the abominable elevated U-turn on C-5 Road or his dangerous (and BF Corp.-fabricated) railings, pedestrian overpasses and the absolutely free gift of a on-off ramp that he gave to the owner of a mall in his home turf of Marikina.

Nobody in authority has really asked why he can declare for the presidency and yet not resign.

Unfortunately, the undeniable effect of letting Bayani do whatever he wants and not forcing him to account for his actions afterward is the breakdown of order, respect for the law and common decency. Ironically for the man who prides himself with a genius for instilling discipline and restoring order, all he’s been doing lately is to show that if you’ve got the power, you can actually get away with anything.

Of course, government officials have been running afoul of the law probably for as long as there’s been a government. But no one in memory has so cavalierly declared himself to be so high above mere legal questions as Bayani Fernando. And the saddest part of it all is, he still has his job.

Maybe, just maybe, somebody will remedy that soon.

He said air quality along C-5, Roxas Boulevard and other major roads in Pasay City has also remarkably improved because carbon dust and other pollutants coming from trees and plants and those emitted by vehicle engines are regularly swept and vacuumed by Roadways Cleaning Operations Group (RCOG) personnel using truck-mounted giant sweeping machines as well as gutter and wall cleaners who work round-the-clock on two shifts.

Fernando reported that since the agency launched its massive cleaning and vacuuming operations initially along EDSA along with the crackdown launched by relevant agencies on carbon gas-emitting vehicles, the air that people breathe in these areas is 50 percent cleaner.

He announced that as soon as the ongoing upgrading of sidewalks along Edsa is completed, the RCOG will start to clean walkways regularly and even at night to brush away much dust from gutters and walls of the main thoroughfare.

"Offhand, I can assure everyone that before the year is over, when our sidewalk upgrading program is done, the entire stretch of sidewalks of Edsa would be walkable and people would shun riding jeepneys and buses for short trips," he said.

RCOG chief Francis Martinez said that apart from Metro aides manually sweeping and tending the plants on the road, seven giant mechanized sweepers, three gutter cleaners and four wall cleaners are out in the streets at the break of dawn to clean and vacuum the major roads until 4 p.m.

The second shift of RCOG personnel, with truck-mounted sweepers and cleaners in tow, takes over at 10 p.m. and works until 6 a.m. to clean and vacuum loading and unloading bays, underpasses and tunnels, Martinez said.

He said the difficult and dirtier job of cleaning the street infrastructure is being done by mechanized sweepers due to the spate of road accidents.

House to force Fernando to attend hearings

Two senior House members have filed a resolution that would compel Metro Manila Development Authority Chairman Bayani Fernando to attend hearings after he snubbed a recent Commission on Human Rights (CHR) hearing over MMDA’s cases of alleged unlawful evictions of sidewalk vendors.

House Resolution 723, authored by Reps. Roilo Golez of Parañaque and Matias Defensor of Quezon City, directs the committee on human rights to hold hearings on human rights violations of the MMDA and force its chairman to rebut the charges.

Fernando, however, shrugged off reports that the two congressmen filed a resolution to question him on alleged human rights violations committed by the agency against sidewalk vendors.

"The proper venue for that is the court. I will only submit myself to investigation or interrogation only if it will be done through court proceedings," Fernando said in an interview.

Investigation nga ito. wala ka bang alam sa batas? may powers ang congress para tawagin mga opisyal ng executive branch. kasama doon si bayani. baka naman akala ni bf monarchy tayo at siya ang hari.

He said "it is already outside the power of Congress to intervene in such matters which... are being treated as a political issue."

"Not one of them is even my congressman. They should not interfere on things like this. What they should attend to are the needs of their respective constituents," Fernando added.

In a joint statement, Golez and Defensor branded Fernando as "callous" after he continuously refused to answer complaints against the MMDA filed before the CHR by sidewalk vendors and informal settlers in Metro Manila, who have all been victims of the agency’s harsh and "inhuman eviction."

"Fernando… has not attended the hearings before the CHR, showing his disregard not only for the rule of law but also for his responsibility to account and be responsible for his actions and the enforcement and implementation by his men," they said.

Golez, a known critic of Fernando, said there is a need for a House probe, as he cited a news report in which CHR chairwoman Leila de Lima said the MMDA is being "very highhanded. Their approach is authoritarian, and that is not good. The illegal settlers should be helped, not treated that way. It has become really alarming."

Golez, who belongs to the opposition bloc, said the MMDA "should not employ excessive or unnecessary violence on street vendors and resort to the destruction of their means of livelihood, nor resort to illegal or unlawful means in carrying out their functions."

Defensor, chairman of the House committee on justice, said even the Presidential Commission for the Urban Poor, in its report, observed flaws in the conduct by the MMDA of its demolition and eviction operations in urban poor communities.

"The patently harsh and whimsical method by which the MMDA is carrying out its operations constitutes human rights violations," he said.

Fernando’s AM station on hold

Meanwhile, several congressmen have decided to hold in abeyance a legislative franchise sought by the MMDA to put up a nationwide AM radio station , even if the agency’s scope is just within the metropolis.

Defensor, Judy Syjuco of Iloilo and Nanette Castelo-Daza of Quezon City and Ruffy Biazon of Muntinlupa City expressed apprehension that Fernando might use it as a campaign vehicle for his presidential bid in 2010 "with or without the support" of his party, the ruling Lakas-Christian Muslim Democrats.

Iloilo Rep. Ferjenel Biron, who heads the House committee on legislative franchises, is "doubtful" of the radio station’s objective, as MMDA already has a newspaper known as Pahayagan ng Bayan in which pictures of Fernando are the "main features" of its issues.

The deliberations were also suspended because Fernando did not attend the hearing, no documents were presented to prove the MMDA Council – composed of Metro Manila’s 17 mayors – approved the application for franchise, and the lack of endorsement from the Office of the Press Secretary.

MANILA, Philippines—It’s a case of too early the hero for Bayani Fernando, it seems. The Metro Manila Development Authority (MMDA) chairman has made his political intentions clear by plastering his face all over MMDA-managed traffic islands and posts some two years before the presidential election, and he is threatening to do the same thing all over the country. The self-promotion is calculated and well-engineered (it’s not for nothing that Fernando is an engineer and construction businessman). It ensures he’ll be in the public’s reckoning when the time to pick presidential candidates comes around. If he does not make it, he can still be in the running as a running-mate or falling short again, as a candidate for the Senate, that chamber of presidential pretenders.

Fernando is already a pretender and interloper—at the expense of the public. And his pretentiousness knows no bounds. In the run-up to the Ninoy Aquino Day and National Heroes Day, the MMDA distributed stickers and other paraphernalia bearing his name, which means “hero” in English. Motorists put the stickers on their windshields and those who violated traffic rules were reportedly treated leniently by MMDA traffic enforcers. Pressed to explain the stickers, the Land Transportation Office said it’s illegal to put just any sticker on windshields and asked motorists to remove them.

The attempt at self-canonization is both pathetic and sacrilegious. Only the extreme egoist could put himself on the level of patriots and heroes, who are there in the pantheon not by self-aggrandizement but by collective acclamation. And if heroism, in the case of Aquino and others like him, is self-sacrifice and self-immolation, how can Fernando claim to be in their league? He is making martyrs of us all by his insufferable arrogance.

Parañaque City Rep. Roilo Golez has asked Fernando to junk his presidential ambition. He pointed to recent surveys showing Fernando nowhere near the magic circle of presidential hopefuls. Making fun of Fernando’s propensity to put U-turns at just about every busy street in the metropolis, Golez said, “It’s time he makes a U-turn on his presidential ambition.”

The issue is more than popularity and whether or not Fernando has a fighting chance in his presidential bid. The issue is using the people’s money for electioneering. By filling the streets with his self-advertisement, Fernando is using public funds for self-aggrandizement. The widespread and sustained campaign to put his face and name at just about every corner of the metropolis goes way beyond the bounds of public information. Who is paying for his huge tarpaulins hanging along major roads? Who is paying for his provincial trips, including the one in Aklan province where he brought along the MMDA band?

In fact, Fernando has gone beyond mere self-promotion. Some eager-beaver senators who harbor presidential ambitions may have suddenly become very visible around the country via giant billboards and print and broadcast advertisements where they espouse their favorite advocacies and pet projects. In some instances, they have become endorsers and image models of skin whiteners and other vanity products. But at least they are not using public funds for their visibility campaign.

This is not to say that Fernando’s very evident electioneering should be stopped, and those of the other tolerated. This is why we join the call of Sen. Miriam Defensor-Santiago for the Commission on Elections to enforce the Omnibus Election Code of 1985, particularly Sec. 80, which makes it unlawful for any person to engage in an election campaign or partisan political activity, except during the campaign period.

As Fernando and the others have shown, the prohibition against premature campaigning has been blatantly circumvented by self-advertisements disguised as advocacy or lifestyle ads. The presidential hopefuls may not have declared their intentions, but this is specious and a manifestation of bad faith at the least. They have been campaigning all along at the cost of public resources and, in the case of Fernando’s tarpaulin madness, at the cost of public space. All of this vainglorious self-promotion has made Metro Manila a terrible eyesore. Fernando and the other presidential aspirants should stop inflicting their images on the motorists and the general public.

Finally—and to no one’s surprise—the metropolis’ chief traffic aide, the father of the U-turns and of state-sanctioned bus-jackings, has declared his intentions. Typically, Fernando says he will run for president in the next elections with or without the support of the ruling Lakas-CMD coalition.

All the same, Bayani told an interviewer that he is confident of the endorsement of President Arroyo and other party leaders because he is qualified to be the next “no-nonsense president of this country.” Never mind if his name isn’t even one of those being considered by the coalition for the position.

“I’m the only one of the presidential hopefuls who has declared my intention to run this early,” he declared. As if that would improve his chances of winning.

But Bayani hinted that he already has the money and the organization to run a nationwide campaign. “Even if the party doesn’t pick me, I will continue with the campaign because I have a lot of friends who will help me,” said the MMDA chairman, who likes to be addressed “Secretary Fernando.”

But President Fernando? To paraphrase the old joke, I was told when I was young that anyone could become president. With Bayani gunning for the highest office in the land, now I know that to be true.

In a way, we should be grateful that Fernando has announced his candidacy. Being a mere appointed official, he must now resign from his post if he has any shame and sense of propriety—or be fired posthaste by his boss.

Why? Because from here on in, anything Bayani does can and should be interpreted as being done in furtherance of his declared ambition. And he retains an undue advantage over other candidates who do not have taxpayers bankrolling his high profile—including the giant posters of himself that do nothing but add to the billboard forest that blights the city.

Of course, the Omnibus Election Code’s Article IX, Section 66 states that “any person holding a public appointive office or position, including active members of the Armed Forces and officers and employees in government-owned or -controlled corporations, shall be considered ipso facto resigned from his office upon the filing of his certificate of candidacy.” But since Bayani has declared for the presidency this early, he must understand that not all of us taxpayers are among the “friends” he brags about, and some of us will not foot the bill for his overweening ambition.

There is a reason why the law prevents people holding appointive office like Bayani from using their position to further their political plans. And just because he has declared but has not filed his certificate (something he can’t do anyway, because Comelec isn’t accepting any at the moment) doesn’t mean that Bayani can’t launch his campaign using money that he doesn’t own or wasn’t donated to him by his so-called friends.

As soon as Bayani steps down, he can campaign all he wants using his own money. But until he does, will the voters please remember that the MMDA chairman is using taxpayer funds and is even getting a salary to get to Malacanang?

Where are those eager-beaver Senate investigators—many of them also undeclared presidential candidates quick to strike down any potential rival in 2010—when you really need them?

Speaking of Bayani’s friends, we wonder if mall magnate Henry Sy isn’t among those people that the MMDA chairman is counting on to provide major funding for his early-bird campaign to become president. That’s because some people in Bayani’s home turf of Marikina City (where Bayani’s wife Marides Carlos Fernando, or MCF, is mayor) are asking why Sy’s newest mall on the eastern bank of the river on Marcos Highway was provided a free off-and-on ramp complex by the government—which is supposedly short of funds for any major infrastructure project that presumably has higher priority.

And how true are reports that the contractor for the new SM Marikina mall is none other that Bayani’s own BF Corp.? With Bayani acting as Metro Manila regional development council boss, his wife as the local chief executive providing all the city permits and his construction company building the mall and the taxpayer-funded ramps, you have to wonder if Sy isn’t way up there in the list of Bayani’s most favored.

As for the less moneyed people who seem to want to be counted among the friends of the MMDA chairman, how true are the reports buzzing all over the Internet that vehicles that carry the overly large “BAYANI” banners with the flag on them are routinely waved off by MMDA traffic enforcers when they violate traffic laws? And, like the tarpaulins along Edsa and elsewhere that feature Bayani’s face, is taxpayer money being used for these rolling campaign streamers, as well?

To the people who have asked me if the report that traffic aides give stickered vehicles a free pass is true, I routinely reply that I wouldn’t really know. The last thing I would do to my own car is to plaster the name of Bayani along its entire length—and I drive a very small car.

Bayani, of course, has been known to brush aside any criticism of his official acts—especially about their legal aspects. Which should give anyone who considers his candidacy pause.

I get it bakit hindi manakikinig si BF sa mga critics nya. nabingi na siya sa sarili nyang boses. hahaha

But that’s Bayani all over. Except that now that he’s a declared presidential candidate, he must know that he cannot brush aside all questions about his actions, official or otherwise.

No-nonsense president? We should be thankful that the presidency is one of those positions Bayani can’t get appointed to and abuse.

However, MMDA general manager Roberto Nacianceno admitted the stickers with the words "BAYANI" and the Philippine flag beside it were from the private fund of MMDA chairman Bayani Fernando.

"Pera ni chairman (Fernando) 'yun...sariling pondo ni chairman (That is from chairman Fernando's private fund)," Nacianceno said in an interview with radio dzBB's Mike Enriquez.

The MMDA official said the distribution of stickers was a private effort of Fernando and the MMDA has nothing to do with it.

He added MMDA employees were not authorized to distribute it.

He said only those posters and tarpaulins which indicate "Government Property" or "Printed by MMDA" are funded by the agency.

He believed some private individuals have put on "BAYANI" stickers on their vehicles.

"'Yung iba baka ginagawa na lang at dinidikit on their own (Maybe some, on their own, posted a similar sticker)," Nacianceno said.

Stickers bearing the word "BAYANI" are on buses plying Metro Manila's roads.

The stickers are synonymous to the word "hero," a fitting tribute as the country commemorates Ninoy Aquino's death anniversary and the upcoming National Heroes' Day.

But "Bayani" is also the name of Manila's traffic czar, Metropolitan Manila Development Authority (MMDA) chairman Bayani Fernando.

With the long vacation up ahead, passengers could not help but react to it.

"Para saan... Wala pa namang personality si Fernando na magkaganyan di ba?," said commuter Mario Rafael.

"Double purpose siguro.... So OK lang siguro na magdikit ng bayan but not for personal [reasons]. Magpakabayani na lang siya," said commuter Brenda Caingol.

But the Integrated Metropolitan Bus Operators Association (IMBOA) defended the posting of the stickers.

Posted two months ago, it was meant to celebrate the country's independence.

"Kung kay Chairman Fernando yan, marami sigurong operator na natutuwa kay Chairman dahil iba na yung ugali niya ngayon," said IMBOA president Claire de la Fuente.

Philippine Sports Commission chairman William “Butch” Ramirez said the Philippines should now focus its efforts on the very few sports which give the country a realistic chance of winning a medal.

“Talent identity should start very early and those chosen must have the commitment to train long – eight to 12 years – to win a medal in the Olympics,” he said.

Thailand, which won two gold medals, one silver and two bronzes in the Beijing Olympics, had put its full support behind weightlifting and boxing and is now reaping dividends.

The talent-identity program for boxers in Thailand starts at age 10 since this is the time kids are introduced to muay thai, the national sport.

There is at least one muay thai boxing tournament every day throughout Thailand and there are more on Saturdays and Sundays,” Pradit Nitiyanant, senior editor of a Bangkok newspaper said.

All five of Indonesia’s Olympic champions are badminton players.

Vietnam, toughened by one of the longest, brutal wars in recent history, has put emphasis on its taekwondo training. With its lean delegation to the Olympics, it had only two Olympic medals – the first in 2000 and the second in 2008 – both in taekwondo.

Malaysia is shifting from the medal-rich event of swimming to badminton while Singapore is into table tennis, a low-profile sport ruled traditionally by China.

Ramirez said giving all 36 sports in the Philippines equal support would not only spread the resources thin but will lessen the full support elite sports need to be competitive in the Olympics.

“Even if you have a P30 million Olympic program a year, that won’t solve the problem because it s just a short cut. We need long term efforts and long term commitments,” he said.

MANILA, Philippines--An in-house study by the Metropolitan Manila Development Authority showed that its often-maligned U-turn slot scheme on major thoroughfares save some P40-P50 million in fuel every year, the agency said on Sunday.

The MMDA also said that its rerouting schemes have been enabling motorists to save more than P2 billion every year since 2005 in terms of gains in opportunity and productivity as a result of speedier traffic.

The cost-savings analysis was based on findings from the monitoring and study of Metro Manila traffic by the Traffic Engineering Center of the MMDA, the agency's public information office said.

"In terms of fuel savings only, P42.84 million is saved every year since 2005 on normal U-turn slots on non-widened roads, while P51.45 million is saved on U-turn slots on widened roads," MMDA Chair Bayani Fernando said.

MMDA officials said the savings resulted from significant increases in the average vehicular speed along the 23 U-turn slots set up by the agency on major thoroughfares.

"In terms of total savings to motorists, or the savings in take-home pay and ... opportunity and productivity, it was revealed that up to P2.33 billion is saved every year since 2005," the MMDA said.

MMDA officials said that despite the brickbats thrown their way because of the "unconventional" U-turn slot scheme, "what they don't know is that the U-turn slot has operational efficiency in time and space."

"At a U-turn slot, the flow of vehicles is non-stop and non-gap," the MMDA said.

"This is felt even more when traveling at night, in which the flow of traffic at the U-turn slot is continuous, unlike some corners where motorists need to stop at the red light," the agency said.

Last week, the TEC also reported much faster travel times along C-5 Kalayaan, which registered an increase of 90 percent since the elevated U-turn interchange was formally opened to motorists.

"The U-turn or modified rotunda scheme is one of our solutions in areas with traffic gridlock problems like C-5 Kalayaan," Fernando said in a statement issued by the PIO.

The MMDA further said accidents arising from the use of concrete barriers at U-turn slots accounted for 0.13 percent of total road accidents, or 84 cases from a total of 63,072 since 2007.

The agency said the figures were based on the Metropolitan Manila Accident Reporting and Analysis System, which studied data from all police stations in Metro Manila.

Based on the data, from January 2005 to July 2008, 2,344 accidents occurred at 11 intersections on Edsa with signal lights, compared to just 499 accidents at 23 U-turn slots in the area.

It also showed that eight deaths and 237 injuries were monitored at intersections with signal lights, compared to just five deaths and 43 injuries at U-turn slots, the MMDA said.

BEIJING—They flew here to look for the best and brightest athletes but, after three dismal Philippine failures—in shooting, weightlifting and swimming—members of the Filipino media were caught wondering who’s the dumbest among the early Filipino losers.

That’s no longer funny. Especially for Jose Cojuangco, intrepid head of the Philippine Olympic Committee, who in Manila loved to say he smelled a medal for the Filipino in this 29th Summer Olympics.

what the fuck! ano pinagsasabi nitong kumag na ito? ano klaseng columnist ito si recah trinidad. ikaw recah ang biggest flop sa olympics. second biggest flop is your son, chino.

hirap kasi sa mga sports columnist mga frustrated athletes. rereklamo ka pa recah at dismal ang performance ng philippines sa olympics eh kayong mga sports columnist din dapat sisihin kasama ang mga sports officials. baket? eh puro basketball ang sinusulat at pinopromote ninyo. palagi na lang basketball ang laman ng mga sports pages. paano na ang ibang sports? Good that Cojuangco, an incurable optimist, did not predict an outright first gold medal for the Philippines.

A grizzled politician, the man also knew the honest limitations of the 15-man RP contingent that pitifully got outnumbered by free-riding officials.

So let the search for the biggest flop begin.

Shooter Eric Ang did the (dis)honor of starting silly by shooting anything but the birds in the trap event, RP’s first bid on the first day of Olympic action.

Ang, said to be a crony of a Malacañang’s favorite governor from the North, did his best as promised but, as fate would have it, missed all but one of the targets to finish at the bottom.

He got disoriented, overwhelmed, he explained, obviously thinking he was out on a merchant group hunt for tame October snipes.

Instantly, they also had to wonder if this was the same lone entry that made Cojuangco predict a possible medal in shooting.

In fairness to Hidilyn Diaz, a cute, tiny weightlifter, she had said she did not realistically hope for a medal here, not even if all the top bets fell ill on competition day.

The daughter of a tricycle driver from Zamboanga, she inevitably developed a liking for the sport after her unforgiving daily task of hauling hefty pails of water from a far-off well for household use.

Of course, she could have finished better than 11th in a field of 12.

A bit odd but you also have to look and listen as she made the wholesale, straight-faced vow to win in the next Olympics.

“I’m sure I can win in London,” she told the Philippine Daily Inquirer as she toured the vast, sun-beaten, crowded Tiananmen Square on Tuesday.

Her best lift of 107 kilos in the snatch bested the RP mark; although the eventual winner did 134 kilos.

She’s only 17 and her coach, Seoul Olympian Ramon Solis, pointed to the fact that the gold hauler from host China team was already over 30, twice the age of Hidilyn.

That alone should put Diaz out of the dumbest scroll.

But readily giving shooter Ang a run for his money at the end of action Tuesday was the celebrated swimmer Miguel Molina, voted most outstanding athlete of the 2007 Southeast Asian Games.

After surprisingly pulling out of his first event, Molina returned to the pool to take a shot at the 200-meter breaststroke semifinals later Tuesday.

Lucky he did not drown.

Molina was so mediocre he could only clock 2:16.94, a far cry from the 2:16.62 he registered in breaking the national mark while in the United States.

That record swim, by the way, qualified Molina to the Olympics but the phenomenal tanker who did that feat has so far not shown up in the current Beijing Summer Games.

Anyway, there should be a turn for the better when boxer Harry Tañamor, the top RP medal hope who was still overweight Tuesday, has fought his first bout against a Ghanian late Wednesday.

At least two other top medal bets, taekwondo’s Antoinette Rivero and Tshomlee Go, will join in the lonely medal hunt later.

Meanwhile, long jumper Henry Dagmil, whom Cojuangco had predicted would make the standard and readily qualify, will compete on Saturday.

Dagmil made it as the country’s mandatory male entry in athletics after failing to sail past the Olympic qualifying mark despite repeated tries.

There are solid signs he would be a lead flop among failed RP campaigners here after Saturday.

MANILA, Philippines--El Shaddai Leader Mariano "Mike" Velarde said on Sunday he suggested to President Gloria Macapagal-Arroyo that she abandon plans to amend the Constitution until after the end of her term in 2010, warning that to amend the country's charter now would be divisive.

"My position is always to have a constitutional convention in 2010 so that the issues can be extensively discussed," Velarde said in an interview with the Philippine Daily Inquirer (parent company of INQUIRER.net).

"My advice was to postpone Cha-cha—it's very divisive—and to have Con-con by electing delegates during the elections. Let it go until 2010," he said.

Inspite of an upset stomach and fever last week, Arroyo joined 35,000 El Shaddai faithful during rain-drenched celebrations at the Quirino Grandstand on Saturday night, marking the 24th anniversary of the religious movement and Velarde's 69th birthday.

The President had dinner and heard a 10 p.m. Mass with Velarde and his family. According to El Shaddai members, she stayed for about three hours. They also noted that it was her longest stay in the prayer-rally, as she usually only attended the mass.

The spiritual adviser to the President said he discussed with her moves to change the 1987 Constitution and proposals from administration allies in the House of Representatives to extend her term, which would end in 2010.

If the overhauling of the 1987 Charter were left to lawmakers, Velarde said it would not be representative of the people's wishes. He said he also expressed suspicions that some lawmakers would push for their own interests, referring to proposals to extend the terms of incumbent elected officials.

"Cha-cha will not solve our problems," Velarde stressed.

Should the proposal for a constitutional convention push through, Velarde said he "might consider" running for delegate. "I want a Charter that is really reflective of the people and suited for what we are today," he said.

Velarde, whose charismatic movement boasts of around five million members, said he expected moves in the House to amend the Charter would peter out. He said the proposal had many legal hurdles to overcome and that some senators opposed the measure.

He also told the President that tinkering with the Constitution to make way for the peace agreement between the government and the separatist Moro Islamic Liberation Front (MILF) would be a bad move for the country in the long run.

"What would stop other groups from calling for the same? It's a bad precedent," he said.

The President did not say anything about his advice, Velarde said. However, she explained that the idea to change the 1987 Constitution did not come from her but from the April resolution filed in the Senate by Minority Leader Aquilino Pimentel Jr.

"She was exploring the possibility of federalism under the proposal of Senator Pimentel," Velarde said.

Malacañang has announced support of Pimentel's federalism bill as it would allow the creation of the Bangsamoro Juridical Entity envisioned in the draft memorandum of agreement with the MILF.

Velarde also noted that the President acknowledged that any plans to amend the Charter from the House would not succeed unless the Senate would support it.

As to proposals to extend the President's term beyond 2010, Velarde said he believed that it was not part of Arroyo's plans.

Velarde said the President asked for his support so that her projects would be completed before the end of her term. She did not ask for his support in her allies' campaign for Charter change and the reported extension of her term, Velarde stressed.

BEIJING—Flying Scotsman Chris Hoy equalled a 100-year-old British Olympic record on his way to winning his third gold medal of the Beijing Games on Tuesday.

Hoy, who had already won gold in the team sprint and keirin, claimed his first ever Olympic sprint crown after a dominant display over teammate Jason Kenny.

Kenny, a 20-year-old from Bolton, England, who is competing in his first Olympics, picked up the silver and will go home with two medals having won gold in the team sprint with Hoy and third team member Jamie Staff of England.

The bronze medal went to Mickael Bourgain of France after he dominated Germany's Maximilian Levy in a third leg decider.

The 32-year-old Hoy, who was born in Edinburgh, now has a total of five Olympic medals, four of them gold.

In Athens he won the kilometer time trial crown on its last Olympic appearance and in Sydney four years earlier he claimed silver in the team sprint behind France.

The last time a British athlete won three Olympic golds in a single edition of the Games was in 1908 when swimmer Henry Cotton took triple gold.

After his displays in the keirin and team sprint, in which he was unbeaten, Hoy went into the final against his younger teammate as the big favorite.

However Kenny has been one of the revelations of the track here, and gave Hoy a run for his money in their first match where Hoy had to make an effort to come back and take the win at the finish.

With victory in sight, Hoy kept Kenny on a tighter rein in the second match, and although it was neck and neck coming round the final bend Hoy was celebrating before he came over the finish line.

“Because of these sneaky attacks, as commander-in-chief, I have ordered the AFP and PNP to defend every inch of Philippine territory against MILF forces and immediately restore peace in affected areas in Lanao del Norte,” Arroyo said in a statement she delivered at the new executive building briefing room.

Arroyo said the government would “not tolerate and would not crush any attempt to disturb the peace and development in Mindanao.”

A House oversight committee hearing is botched when Typhoon Helen’s rains submerge streets, stalling resource persons; now, five lawmakers want Metro Manila Development Authority Chairman Bayani Fernando to explain billions of pesos for flood control down the drain.

The legislators from the National Capital Region said they would grill Fernando when Congress resumes sessions.

The group led by Parañaque City Rep. Roilo Golez said the probe on MMDA’s spending would be held right after President Arroyo has delivered her State-of-the-Nation Address on July 28.

The President is expected to present the 2009 national budget including the appropriations for the MMDA and its projects.

But Fernando challenged Golez to present evidence, insisting that he would stay put despite moves to oust him.

“What multi-billion peso fund is he talking about? Give us the data,” he said. “I am not resigning.”

Joining the Fernando-bashing are Rep. Rufino Rossano Biazon of Muntinlupa City; Rep. Oscar Malapitan, Caloocan City; Rep. Vincent Crisologo, Quezon City; and Rep. Magtanggol Gunigundo, Valenzuela City.

The House’s Metro Manila Development committee under Quezon City Rep. Maryann Susano will look into the agency’s expenditures while appropriations committee holds a separate inquiry when Congress starts hearings for the 2009 national budget.

The quintet was reportedly dismayed over low-lying sections of the metropolis went underwater on Wednesday as classes were suspended, business ground to a halt and a hearing of the House committee on oversight wherein floods got in the way of resource persons going to the Batasan.

“Bayani Fernando bragged on Aug. 10, 2007 that there would be no more floods this year,” Golez said.

Fernando denied making a promise to solve this year the problem of a sinking metropolis.

“I never said by 2008 Metro Manila will be flood-free. What I said is that floods will be reduced [by] efforts to dredge all drainage systems and waterways, and relocate informal settlers.”

Malapitan, Crisologo and Gunigundo said their districts were always “at the mercy of the floods” because of poor drainage.

Gunigundo cited tidal conditions, a “natural phenomenon” that also hit neighboring Malabon and Navotas, and some parts of Caloocan City.

Gunigundo and Biazon noted that Fernando has become “very visible” in disaster areas like where a team from MMDA helped clear streets of mud and other debris following Typhoon Frank’s visit last month.

“Although everyone has to do his share to help those who are in need, it should not be at the expense of the people in Metro Manila,” Gunigundo said.

“Fernando is not fully concentrated on the problems of Metro Manila,” observed Biazon. “He is too busy going around the country on personal political sorties... even the things he’s doing in Metro Manila is geared towards enhancing his political agenda,” he added.

Rep. Roilo Golez (Ind., Parañaque), his arch-critic, believes so.

He lambasted Fernando yesterday for what he described as the MMDA chairman’s repeated denials that he never vowed to stop the perennial problem of flooding in Metro Manila this year.

Golez also chided Fernando for claiming that MMDA has only a P200-million annual allocation for flood control, a statement that the lawmaker said could easily be belied by official records from the Office of the President which has direct supervision over the agency.

Citing two occasions when Fernando made his vow to end flooding in the metropolis, the congressman recalled that the MMDA chairman first assured President Gloria Macapagal-Arroyo on June 9, 2005 that with the onset of the rainy season, the incidence of flash floods in Metro Manila will in all probability, now be a thing of the past.”

Golez said he was present when Fernando made such statement as he was still the President’s national security adviser.

In the second incident, the solon cited the newspapers’ headlines on Aug. 10, 2007 quoting Fernando that there would be no more floods in Metro Manila “next year (2008)” which, Golez said, proved to be “very false” because of the heavy floods in several areas of the metropolis, disrupting businesses and delaying the proceedings of a congressional investigation.

Golez said Fernando lied for claiming that the MMDA has only P200 million per year on flood control, explaining that the amount is what is only projected on the agency’s budget for the project in the General Appropriations Act.

The MMDA, according to Golez, receives between P200 million and P300 million a year from the internal revenue allotment (IRA) as provided for in Section 10 of Republic Act 7924.

The amount is apart from the P700 million to P800 million that the agency receives from the 17 cities and municipalities of Metro Manila from their own IRA, he said.

Golez said that on Aug. 17, 2007, then Press Secretary Ignacio Bunye announced that President Arroyo has transferred the flood control funds of the Department of Public Works and Highways-National Capital Region (DPWH-NCR) offices to the MMDA to enable the agency perform its “mandate of flood control, garbage collection and traffic management.”

Altogether, Golez estimated that MMDA has more than P1 billion in its disposal a year and “several billions since he became chairman in 2002.”

Golez said that even Budget Secretary Rolando Andaya Jr. has confirmed that the IRA of the metropolis reached P218 billion last year, giving a bigger share for the LGUs and MMDA.

Quezon City Mayor Feliciano Belmonte Jr. said his city alone gives P250 million a year from its IRA but Fernando, according to Golez, claimed is “hardly enough for garbage collection.”

Despite the huge amounts of money from IRA and other sources, Golez wondered why Fernando has continued to ask for “a higher budget” for the agency.

MANILA, Philippines -- Following this week's heavy rains and flooding, Metropolitan Manila Development Authority (MMDA) Bayani Fernando has promised resident of the National Capital Region a flood-free metropolis by next year.

"The public can expect a flood-free Metro Manila when the Camanava (Caloocan, Malabon, Navotas and Valenzuela) Flood Control projects and the new West Manggahan pumping station become operational next year," he said.

In a statement, Fernando said the operation of the West Manggahan pumping station at the boundary of Taytay and Cainta in Rizal would soon be turned over by the Department of Public Works and Highways to the MMDA.

The decision to place the station under the MMDA was attributed to his agency's bigger number of flood control personnel, Fernando said.

Equipped with four huge mechanical pumps, the West Manggahan station can serve, among other towns, Taytay, Cainta, and Pateros, as well as Pasig City and other eastern suburbs, by keeping water flowing to the main tributaries, he added.

Fernando said the Camanava Flood Control projects would also fall under the control of the MMDA once they become operational next year.

The completion of the Spine pumping station is expected next year, along with the Catmon and Bangkulasi pumping stations in Malabon and Navotas, respectively.

Fernando also took pride in what he called the "fast recession" of flash floods caused storm Chedeng.

He attributed this to "relentless flood mitigating measures such as cleaning and clearing of illegal settlers…along waterways and other danger areas in Metro Manila."
